1. Agreement to these terms

By accessing www.genb-cabinets.com (the "Site") or purchasing products from GEN B Cabinets ("Gen B," "we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Site.

2. Who we are

Gen B manufactures kitchen cabinetry and related products. Products may be produced outside the United States and shipped to customers within the United States as described on the Site and in your order documentation.

3. Use of the website

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others.

• You may not misuse the Site, attempt unauthorized access, or interfere with security or performance.
• Content on the Site (text, images, logos, and design) is owned by Gen B or its licensors and is protected by intellectual property laws.
• We may suspend or restrict access if we reasonably believe there is a violation of these Terms or risk to the Site or other users.

4. Quotes, orders, and specifications

Product descriptions, images, and specifications on the Site are for general information. Colors and finishes may vary by display and lighting. Final details (dimensions, configurations, finishes, and pricing) are confirmed in your written quote or order acknowledgment.

• Custom or made-to-order items are built to the specifications you approve. Review all shop drawings and order details carefully.
• Lead times and production schedules are estimates and may change due to supply, freight, or events outside our reasonable control.
• Changes after approval may incur additional cost and delay.

5. Pricing and payment

Prices are in U.S. dollars unless stated otherwise. Taxes, shipping, freight accessorials, and duties (if any) may be additional and will be disclosed before you commit to an order where practicable. Payment terms are as set out in your invoice or contract.

6. Shipping and delivery

Delivery is to the address and terms stated in your order. Risk of loss and title pass as stated in your order or bill of lading. You are responsible for inspecting shipments promptly and noting visible damage on the delivery receipt and notifying us according to the instructions provided with your order.

7. Returns, cancellations, and warranty

Custom and made-to-order cabinetry is typically non-cancellable and non-returnable once production has started, except as required by law or expressly agreed in writing. Warranty terms are provided separately (for example, limited warranty materials supplied with your order). Nothing in these Terms expands any express warranty we provide in writing.

8. Disclaimer

To the fullest extent permitted by applicable law, the Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by applicable law, Gen B and its affiliates, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Site or products, except where such limitation is prohibited by law. Our total liability for any claim arising out of or related to these Terms or the Site (except for claims that cannot be limited by law) shall not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid to us for the specific product or service giving rise to the claim in the twelve (12) months before the claim arose.

10. Indemnity

You agree to defend and indemnify Gen B against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, violation of these Terms, or violation of third-party rights, to the extent permitted by law.

11. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. You agree that state and federal courts located in Miami-Dade County, Florida have exclusive jurisdiction for disputes arising from these Terms or the Site, subject to mandatory consumer protections in your state of residence where applicable.

12. Changes

We may update these Terms from time to time. The "Last updated" date at the top will change when we do. Continued use of the Site after changes constitutes acceptance of the revised Terms.
